This is a detailed look at the probate civil commitment process from start to finish. Attendees will learn about the civil commitment process in the probate court and the requirements for an individual to be found a mentally ill person subject to court order under R.C. 5122.01(B). There will also be discussion on how criminal cases are handled when they are sent to the probate court under S.B. 2.

Topics will include:

  • A quick discussion about the proposed mental health rules in Montgomery County Probate Court
  • Emergency Hospitalization or “pink-slipping” under R.C. 5122.10 and relevant court cases (In Re Miller and In Re J.L.S)
  • Community Mental Health Affidavits and judicial hospitalization under R.C. 5122.11
  • S.B. 2 and the transfer of cases from criminal to civil
  • Ohio’s Three-Part Mental Commitment Test
    • Substantial Disorder of Thought Mood and Memory
    • Gross Impairment of Judgment, behavior, capacity to recognize reality, or ability to meet ordinary demands of life
    • R.C. 5122.01(B) Requirements
  • Psychotropic Medications for Mentally Ill Persons Subject to Court Order
    • Steele v.  Hamilton County Mental Health Board and requirements for psychotropic medications to be administered.
  • Continued Commitments and Assisted Outpatient Treatment
