Summary

In this [One-Hour(s) (1.0) General CLE Course], Christopher J. (“C.J.”) Peters, Professor of Law at The University of Akron School of Law, In June 2024, for the first time in the nation's history, the U.S. Supreme Court ruled on the scope of presidential immunity from criminal prosecution.  In Trump v. United States, the Court established a wide sphere of immunity for presidential conduct, holding that the president enjoys presumptive immunity from prosecution for all "official acts" and absolute immunity for conduct within the "core" of the president's constitutional authority.  This presentation will summarize the Court's holding, the majority's reasoning, and the concurring and dissenting opinions and will discuss some important implications and unanswered questions arising from the decision.

Learning objectives:  Participants in this CLE presentation will be able to:

  1. Accurately describe the Supreme Court's holding and reasoning regarding presidential immunity in Trump v. United States.
  2. Recognize potential legal implications and unanswered questions arising from the Trump decision.
