Summary

Access to quality education is one of the most important factors, along with a child’s zip code, in predicting future success. Children in the U.S. are entitled to a public education under the 14th Amendment to the Constitution. (Plyer v. Doe). Additionally, access to education is a property right that schools cannot deprive children of without procedural due process. (Goss v. Lopez). Knowing a student’s rights, and the unique laws that apply to especially vulnerable students, such as children experiencing housing insecurity, children with a disability, immigrants, and LGBTQIA+ youth can make all the difference in ensuring that schools provide children with the education they are legally entitled to receive.
